Federal regulators and state partners accused Hims & Hers of charging many users almost immediately after they submit intake forms, then enrolling them in recurring prescription plans before they can review or approve treatment.
The complaint says the telehealth company also shared sensitive health information with Meta, Snap and other advertising platforms despite privacy promises, using customer lists and website tracking tools.
Cancellation was allegedly hard to complete: before 2023, most users had to contact customer service, and even after online cancellation launched, the button was buried behind several steps.
The FTC says the conduct violated the FTC Act and ROSCA; Utah and California added state-law claims in the case filed in federal court in Northern California.
