Summary
A unanimous New Mexico Supreme Court ruling blocked prosecutors from using Alexee Trevizo’s hospital-room bodycam statements and hospital surveillance video in her murder trial.
Justice Michael Vigil wrote that Trevizo, 19 at the time, was in an unresolved medical crisis and was not given a chance to exclude two armed officers before her doctor discussed her condition.
The court said that made any waiver of physician-patient privilege involuntary, undercutting prosecutors’ argument that Miranda warnings were unnecessary because she was speaking to hospital staff rather than police.
The excluded footage captured Trevizo saying, “I’m sorry, it came out of me,” after staff found a full-term newborn dead in a tied trash bag on Jan. 27, 2023.
Trevizo, now 22, still faces first-degree murder and evidence-tampering charges in a case built partly on evidence now ruled inadmissible, even as she maintains the baby was stillborn.
