Summary
July travel records show Abdulloi Doniyor Toshpulodzoda used a second community pass from Northern Virginia Mental Health Institute to reach Dulles Airport and fly to Dushanbe via Turkey.
A May 29, 2024 court-approved trip let him travel from Falls Church to Washington to obtain updated Tajik embassy documents, and Fairfax prosecutor Steve Descano’s office said it did not oppose that escorted passport-related visit.
Descano’s office said prosecutors still argued at a June hearing that Toshpulodzoda should remain institutionalized, while the Virginia behavioral health department said community passes are legal graduated privileges reviewed by clinical teams and experts.
DHS said his departure amounted to compliance with a final removal order issued June 24, even as Virginia authorities issued a warrant for his arrest if he returns.
The escape has renewed political attacks on Descano’s handling of migrant-related cases in Fairfax County, where Toshpulodzoda had been committed after being found not guilty by reason of insanity in his landlord’s killing.
