Thursday's Goldwater Institute letter gave Boone County health officials until Friday to explain why Kathy Kite must get a permit to keep serving free breakfasts from her Harrisburg home.
July's county notice followed a complaint that someone became ill and said her setup looked like a food establishment, citing an open sign, tip jar, social media posts and a yard sign.
Kite, who began feeding neighbors in May after a local gas station stopped breakfast service, said compliance could require a commercial kitchen costing hundreds of thousands of dollars in her 115-year-old home.
Boone County said it issued no citation or cease-and-desist order and did not threaten jail, adding Missouri rules exempt food for family and friends but require permits when food is offered to the public.
The dispute could move to court: Goldwater says no lawsuit has been filed yet, but legal action remains possible over how far local food-safety rules reach into informal community meals.
