U.S. District Judge Fernando Rodriguez Jr. denied Minnesota’s emergency bid to keep Christian Castro jailed in Texas, clearing the way for his release Thursday unless Gov. Greg Abbott signs an extradition warrant.
Rodriguez said Minnesota’s lawsuit was premature because Abbott has neither granted nor denied the extradition request, and no state or federal law sets a deadline for his review.
90 days after Castro’s June arrest in Cameron County, the sheriff’s office told the court it must release him without a court order or signed rendition warrant.
Castro faces 4 felony assault counts and a misdemeanor false-report charge in Minnesota after prosecutors say he fired 1 shot through a closed door during a January ICE operation, wounding a man in the leg.
The ruling deepens a broader clash between Texas and Minnesota over whether ICE agents can be prosecuted for conduct tied to federal immigration raids and how far governors can delay extradition.
