Trump Appeals $464 Million New York Fraud Liability, Citing 5 Legal Flaws

A Wednesday filing in New York's top court asks judges to void Donald Trump's civil fraud liability and remaining business restrictions tied to the $464 million case.
The appeal says Letitia James lacked authority to sue under Executive Law 63(12), arguing the deals were private commercial transactions involving banks and insurers that were not harmed.
Trump's lawyers also argue property valuations were subjective estimates independently reviewed by lenders, not fraudulent misstatements, and call the roughly $450 million disgorgement excessive and unconstitutional.
The case began with James' 2022 suit alleging about 200 fraudulent acts; Trump was found liable in 2023 and later hit with damages, officer-director bans and a three-year New York lending restriction.
An intermediate appeals court already vacated the monetary award, leaving this appeal focused on overturning the underlying liability finding and the penalties that still remain.
