Overseas citizens and military voters still have two built-in backup paths: the Federal Post Card Application and the Federal Write-In Absentee Ballot. Under UOCAVA, the new USPS ballot rule does not apply to these voters, so they can still use the Federal Post Card Application, or FPCA, to register and request an absentee ballot in one step. Federal law also requires states to provide electronic options for requesting ballots and receiving blank ballots, which reduces dependence on ordinary international mail for the outbound part of the process. If a voter requested a ballot on time but it does not arrive, the main fail-safe is the Federal Write-In Absentee Ballot, or FWAB. That ballot is specifically designed as a backup for eligible military and overseas voters who did not receive their regular absentee ballot with enough time to return it. Guidance from the Federal Voting Assistance Program says voters should use the FWAB as soon as possible if time is short. What matters next is the voter’s state deadline for returning the completed ballot. UOCAVA protections help with access and transmission, but they do not create one national receipt deadline. In practice, the safest approach is to file the FPCA early, use electronic ballot delivery where the state offers it, and submit the FWAB promptly if the regular ballot is delayed.

UOCAVA ballots for military and overseas voters are explicitly exempt from the final USPS rule, which separately recognizes the circumstances facing troops, families and other Americans abroad.
Spanberger had repeated the claim in an Aug. 29 X post and a CNN interview with Wolf Blitzer; an X community note and critics including Sen. Mike Lee later pointed to the exemption.
The dispute sits inside a broader legal fight over Trump’s 2026 mail-voting push: the Supreme Court in August paused an earlier injunction on procedural grounds, while a federal judge has since temporarily stayed key parts of the rule.
