The nonprofit says the fund was designed to compensate alleged victims of political lawfare, including potentially prosecuted and later pardoned January 6 rioters, and argues the arrangement remains opaque enough to be revived.
Todd Blanche said last month the fund “is dead” and never began, but critics note key setup documents lacked signatories and Trump has said he wished the compensation plan had survived.
The fund emerged from Trump’s settlement with the IRS over leaked tax returns; in July, another federal judge said the underlying $10 billion lawsuit was a sham used to give the settlement judicial cover.
