LULAC, Common Cause, UnidosUS and Denver filed suit against DHS and ICE after Secretary Markwayne Mullin confirmed a policy allowing armed ICE officers at polling places for civil immigration enforcement.
The complaint argues that policy violates a Civil War-era federal law barring troops or armed men at election sites unless needed to repel armed enemies of the United States.
Plaintiffs are seeking court action before Election Day to block any deployment, aiming to stop arrests, warrant service or detentions that could intimidate voters.
Even if judges do not immediately halt the policy, the case puts courts on notice for Election Day and could support remedies if polling-place interference occurs.
