Lindsay Clancy Hires Martin Weinberg to Block Retrial in 3-Child Case

Martin Weinberg entered a limited appearance Tuesday for Lindsay Clancy to file a double-jeopardy motion seeking dismissal after her murder trial ended in a mistrial.
An 11-1 jury split reportedly favored finding Clancy not criminally responsible, and her lawyers argue the way the Sept. 4 mistrial ended should bar prosecutors from trying her again.
Sept. 29 is the next court date, though prosecutors have not said whether they will pursue a retrial and the filing did not say when Weinberg will submit the motion.
Weinberg previously made a similar post-mistrial challenge for Karen Read, but a judge rejected it because no formal acquittals were returned and defense lawyers had agreed to the mistrial.
Clancy, accused of strangling her 3 children in 2023, has argued postpartum psychosis left her not criminally responsible; the judge has also kept jurors' identities sealed over safety concerns.
