A 1:22 a.m. breath test after his Aug. 30 arrest recorded 0.224—nearly three times Indiana's legal limit—after two earlier portable tests failed to register, with police citing failed sobriety tests and signs of intoxication.
The 34-year-old faces up to one year in jail and a $5,000 fine on the higher ACE count, though a source told OutKick a plea deal is more likely than jail time.
Indianapolis GM Chris Ballard said the team will handle discipline internally while letting the legal process proceed; Allen also could face an NFL suspension, typically three games for alcohol-related offenses.
