First Circuit Voids Stay on 3rd-Country Deportations, Backing Sept. 18 Due-Process Ruling

A Wednesday mandate from the First Circuit dissolved the March 16 stay that had let the Trump administration keep deporting migrants to third countries while the case moved through higher courts.
The appeals court had already ruled on Sept. 18 that ICE must give migrants a meaningful chance to argue they would face danger in a destination country they were not originally being returned to.
At least one Peruvian migrant was still being prepared for removal to Ghana this week after ICE argued the policy remained usable until the formal mandate issued.
The order leaves in place Judge Brian Murphy's February 2026 decision that such transfers can violate due process by sending people to unfamiliar or dangerous countries without notice.
