Q: Why did police initially leave the suspect's apartment without a search warrant, despite finding the missing woman's car and phone at the scene?

Police initially left because, at that point, they did not believe they had legal grounds to enter or search the apartment. According to Smyrna police, officers responded after Mosley’s family reported that her phone and vehicle were at the apartment complex. An officer stayed about 30 minutes, knocked on doors and spoke with residents, but police said they had no information then indicating a critical missing-person emergency or immediate danger inside the apartment. Mosley had also reportedly last been seen in Atlanta, so the family was told to file the missing-person report with Atlanta police. Under those circumstances, the presence of her car and phone at the complex alone was not enough for police to force entry or obtain a search warrant on the spot. Officers needed either consent, stronger probable cause, or exigent circumstances showing an immediate threat. That changed when witnesses later saw Bradley carrying a container from the apartment, dropping it, and running back inside after realizing he had been seen. Witnesses called police, and officers then found human remains in the container, giving investigators the probable cause needed to pursue warrants and expand the search.

Witnesses triggered the case after seeing Bradley carrying a container at his apartment complex; when he dropped it and ran, they found human remains inside and called police.
A search warrant for Bradley’s car then led officers to trash bags in the trunk, including one tightly wrapped bag outlining a body part; the medical examiner confirmed the bags contained human remains.
Police said they still do not know Bradley’s connection to Mosley, a DoorDash worker whose account was last active Tuesday, and are continuing to search for additional remains.
Bradley also faces a charge of concealing a death, was denied bond in Cobb County Magistrate Court, and is due back in court in October.
