Summary
Andrew Miltenberg, lawyer for one of seven accused former Cornell fraternity members, said Letitia James should personally step aside from the criminal probe because her earlier public comments create an appearance-of-impartiality problem.
James had said the accuser was "forced to endure" something "horrific and unacceptable" and told her and "all survivors" that "we stand with you" before Gov. Kathy Hochul named the attorney general's office special prosecutor on Thursday.
No criminal charges have been filed in the alleged October 2024 assault at Cornell's Chi Phi house; the seven men deny wrongdoing, with some saying the encounter was consensual and others denying participation.
The case regained momentum after Jane Doe sued on Sept. 16, and after former DA Matthew Van Houten said a fuller police-interview transcript he had not received "changes the landscape" of his earlier no-charge decision.
Cornell is separately backing an independent review of its handling of the case; its own disciplinary process produced two expulsions, two suspensions, one graduation before sanctions and two findings of no responsibility.
