Q: Now that the extradition clock has expired, what prevents the released suspect from fleeing across the border?

Very little prevents that in the short term if no new legal hold is imposed. Once Texas’s 90-day extradition detention expired, Cameron County had to release Christian Castro unless a governor’s warrant was served or another valid basis for custody emerged. What still exists is the Minnesota criminal case and the nationwide arrest warrant tied to it. If Castro stays in the United States and is found by law enforcement, he can still be arrested again and Minnesota can renew efforts to bring him to court. Texas could also still approve extradition later if Gov. Greg Abbott signs the paperwork, though that would likely require Castro to be located and re-arrested. What does not appear to exist, based on the reporting, is any current court order, immigration hold, bond condition, passport seizure, or border restriction specifically stopping him from traveling after release. Minnesota officials argued he was a flight risk and cited jail calls about Mexico, but the federal judge declined to block his release and did not create a new restraint. If federal prosecutors were to file separate charges, or if a judge issued a new warrant on another basis, that could immediately change the situation. But as of his release Thursday morning, the main barrier is no longer physical custody; it is the continuing criminal exposure he faces if authorities locate him again.

U.S. District Judge Fernando Rodriguez Jr. ruled a day earlier that he could not stop the sheriff from releasing Castro or force Gov. Greg Abbott to sign the warrant because Abbott has not yet formally denied extradition.
