Success Academy Sues NYSED Over 2026 AP Score Block, Sending Ranking to 196th

Success Academy filed a federal lawsuit against New York State Education Commissioner Betty Rosa after NYSED refused to let the College Board release 2026 AP results to U.S. News for its high school rankings.
That decision left U.S. News to use only International Baccalaureate data for advanced-course metrics, and because Success Academy offers AP rather than IB, it got zero credit for 40% of the ranking and fell from 11th to 196th statewide.
The charter network argues the policy violates the First Amendment by blocking publication of truthful, independently verified academic data and says the score-release practice had been allowed for decades before this year.
NYSED has defended the restriction on student-privacy and anti-commercialization grounds, while Success Academy says the move shields traditional public schools from unfavorable comparisons with charter schools.
The dispute lands amid a broader fight between New York charter schools, district systems and teachers unions; Success Academy says 95% of its 2026 graduates passed at least three AP exams.
