The risk exists because Justice Department lawyers have already argued in court that, without a viable renovation plan, the building could become unsafe and eventually “be required to be taken down,” with alternatives such as an outdoor amphitheater discussed as a possible replacement. President Trump also publicly said the venue could end up being “ripped down” without long-term support. So the practical answer is that court assurances reduce the chance of a sudden demolition, but they do not amount to a permanent legal bar. Jeff Merkley and Lisa Murkowski, who oversee funding for the Kennedy Center and related agencies, pushed the measure as fears grew that the Trump administration could tear down the 55-year-old arts venue.
